and Conditions of Sales & Service
Payment Due
Payments for products listed on the invoice/receipt
are due upon shipment or delivery. Payment for
Service, whether it be on-site or in-house is
due upon completion. You agree to pay the said
amount as specified on the invoice/receipt in
full, unless you have a net terms account. Computer
service is billed hourly in half-hour increments.
(Minimum of one hour)
Overdue invoices, will be assessed a late fee,
the greater of 2% or $5.00 monthly for the duration
of the outstanding balance.
Returned checks and Invoices given to collections
will be subject to a $25 fee payable by cash,
credit card, or cashiers check.
Limited Warranty
Systems:
- All
complete systems that are built by Midnight
Magix are warranted to be free from defects
in materials or workmanship for a period of
one year from the date of the invoice, unless
an extended warranty is purchased at the time
of invoice or warranty changes are stated on
receipt.
Components:
- New:
Most new components purchased which are not
sold as part of a complete system, are warranted
to be free from hardware defects for a period
of at least one year or as specified by the
manufacturer, from the date of invoice. New
component warranties should be handled by their
respective manufactures after 30 calendar days
from invoice. Check with product manufacturer
for further warranty information.
- Refurbished:
All refurbished products carry a 30-day warranty.
- Used:
All used products are sold as is without warranty,
unless warranty information is stated on invoice/receipt.
This
warranty does not cover abuse, misuse, or modification
of the product. Midnight Magix or the Manufacturer
reserves the right to repair or replace the defective
product under warranty as we see appropriate.
We reserve the right to replace defective components
with refurbished ones.
We
do not warranty uninterrupted, error-free, or
undesired operation of a product due to conflicts
or problems with existing hardware and/or software.
We
do not warranty that any product you acquire will
meet your individual needs or requirements.
WE
DISCLAIM ALL REPRESENTATIONS AND WARRANTIES WITH
RESPECT TO THE PRODUCTS, WHETHER EXPRESSED, IMPLIED,
OR STATUORY, INCLUDING ANY IMPLIED WARRANTIES
OF MERCHANTABILITY OR FITNESS OF A PARTICULAR
PURPOSE.
Onsite
warranty: Onsite warranty will
be provided for a specified duration to stated
systems free of charge so long as the system resides
within a fifteen-mile radius of the village of
Herkimer, NY. If the system resides outside of
this area, or if express service is desired, a
fee may be charged.
Service/Repairs:
All services and repairs performed on hardware
by Midnight Magix have a 30 day warranty on labor.
This may only be applicable to any system or component
that is having a reoccurrence of the problem that
was fixed with-in 30 days from date of invoice.
Repairs to Software such as Operating Systems
and Applications have a warranty on labor good
for 48hrs from date of invoice. This does not
apply to new problems or issues whether or not
they resulted from the previous problem.
Money
Back Guarantee
If
for any reason you are not satisfied with the
product(s) you received from us, you may return
it to us and obtain a credit or refund excluding
shipping and handling charges and any restocking
fee as appropriate. To qualify, you must return
the product, along with any accompanying reference
manuals, media, associated documentation and cables.
All items must be in “new” resalable
condition with the original box intact. This return
policy is valid within 14 calendar days of your
store or online purchase on all hardware except
Memory and CPUs, which have to be within 7 calendar
days. Opened software, custom systems and orders
cannot be returned, only exchanged for the same.
Items marked as Used may not be returned and are
sold “as-is”. All returns are subject
to a 20% restocking fee. Refunds on non credit
card purchases of $100 or more and all un-cleared
checks will be issued a refund check via mail.
Returning
Products & Refunds
A copy of your invoice must accompany all returned
products. Returned goods should be freight insured
by you for their current value. Products returned
to you under warranty are shipped freight prepaid
via UPS Ground or other carrier at our discretion.
Midnight Magix reserves the right to charge for
shipping, handling and labor if the product received
for repair is non-defective, out of warranty,
or warranty void.
Telephone
Assistance
If
there is a problem with a product purchased from
Midnight Magix, you should first refer to the
included reference material for assistance. If
you are unable to resolve a problem with a product,
you may contact us for telephone assistance. If
we are unable to assist you in resolving the problem
then you are urged to contact the manufacturer
of the product in question for support. We are
only responsible for the support of complete systems
manufactured by Midnight Magix; other peripherals
are given support at our discretion.
Limitation
of Liability
Under
no circumstances are we liable for the following
(1) third-party claims against you for damages;
(2) loss of, or damage to your records or data
whether by a product or service done to the system;
(3) economic consequential damages (including
lost profits or savings) or incidental damages,
even if you are not informed of their possibilities.
Some jurisdictions do not allow the exclusion
of limitations of incidental or consequential
damages, so the above limitations may not apply
to you.
General
All
of you rights, all of our obligations and all
licensed (except as specifically granted) are
valid only in the US and Puerto Rico. Neither
of us will bring legal action more than one-year
after the cause of the action arose. The laws
of the State of New York shall govern this agreement.
Complete
System Definition
A
complete system manufactured by Midnight Magix
is defined as a computer case (Desktop or Tower),
and accompanying internal components that is built
or acquired from Midnight Magix and is marketed
as new. The system may or may not include a monitor
and / or other external devices. All components
in the complete system also must be purchased
at the time of invoice for the complete system,
and not be added in the future or over a period
of time.
